The Constitutional Status of Healthcare

From The Declaration of independence

Notice, the founding fathers put 'life' before 'liberty'. That has been upheld by the courts. You/we do not have the liberty to put life in jeopardy. Free speech is limited by the right to life. Free choice is limited by the right to life.

The laws inherent in the Declaration of Independence

Consequences of the Law
  1. The first law is that all men have an inherent right to life, equally and independently of each other, that cannot be denied by any power, as this right is inherent, and thus "sacred".
    1. Equal right to life, means, of course, that no one has the right to deprive another of their life.
  2. The Second law is that all men have an inherent right to liberty, limited only by the first law. Our inherent liberty is undeniable in so far as it does not jeopardize the preeminent and sacred right to life.
    1. Liberty, subject to the preeminent first law, does not permit any acts to deprive or jeopardize the life of another,
    2. Equal right to liberty, means that one's liberty does not entitle one to deprive others of their liberty.
  3. The Third law is that all men have an inherent right to the pursuit of happiness, limited by both the first law and the second law.
    1. Pursuit of happiness, subject to the preeminent first law, does not permit acts that would deprive others of or jeopardize their rights to life.
    2. Pursuit of happiness, subject to the preeminent second laws, does not permit acts that would deprive others of or jeopardize their rights to liberty.
    3. Equal rights to pursue happiness does not entitle one to deprive others of their right to pursue happiness.


  1. Right to life entails a right to healing the sick and injured and the right to preventative care, the lack of which would deny or jeopardize life, consequently the right to "life" entails a right to healthcare.

  2. A right to Liberty, entails a right to differences, and to choose, as without differences there are no choices, and without choices, there is no freedom (liberty), consequently the right to liberty entails a right to choose.

  3. A right to the pursuit of happiness entails a right to opportunity and ability to obtain physical and mental health and welfare.
    1. This includes opportunity and ability to make a living sufficient to providing for self and family.
    2. This includes opportunity and ability to obtain sufficient education to become competitive in the job market.
Consequently, the Declaration of Independence dictates that
  1. Healthcare is a right of all men that takes precedence over liberty of all men.
  2. Liberty is a right of all men that takes precedence over the pursuit of happiness of all men.
    • Liberty and differences permit all men to exercise choice.

Life (1), liberty (2), and the pursuit of happiness (3)!

  Healthcare (1), Choice (2), and the pursuit of Wealth (3)!

So say we all. So Say We All! SO SAY WE ALL!!!

Health Care Issues and Options

The Preamble to the Constitution of the United States of America

We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.

Life is Healthcare.
Liberty is Choice.
Happiness is Wealth.

  1. The pursuit of wealth without regard for the opportunity of other to pursue wealth so as to jeopardize the rights of others to pursue wealth denies others the justice of equal rights and opportunity, limits others' rights to choose, and even jeopardizes their lives.
  2. The pursuit of wealth without regard for the rights of others jeopardizes domestic tranquility.
  3. Using wealth to avoid the military disturbs the domestic tranquility, creates the trauma of inequity, and degrades the sense of justice.
  4. Excessive pursuit of wealth without regard for the health and safety of others jeopardizes the general welfare of the population.
  5. Excessive pursuit of wealth limits severely the opportunity and ability of others to achieve adequate health and means to life.
Unrestrained capitalism, the under-regulated capitalist ideal of quid-pro-quo, is a zero-sum perspective that permits exploiting those less able to compete by those more able to compete, showing that all five ideals delineated in the Preamble to the Constitution are jeopardized by the reversal of the order of rights specified in the Declaration of Independence.


Life (healthcare) takes precedence over liberty (choice) by the first law.
Liberty (choice) takes precedence over pursuit of happiness (wealth) by the second law.
Uncontrolled greed (pursuit of happiness [wealth]) creates extreme wealth and income inequity,
which, in turn, jeopardizes the life (healthcare) and liberty (choice) of others.
Uncontrolled greed is the death of America by loss of liberty and life.
Under-regulated capitalism is the cause of massive wealth inequity.
Massive wealth inequity is loss of life, liberty, and the pursuit of happiness for the masses.


The United States of America is 34th in healthcare, well below the middle.


The reason is profit in the capitalist system (which is on top of the cost) and the whole health care insurance ​industry (which is not needed in a healthcare as a right system). These unnecessary costs make the price of healthcare to the consumer too expensive to afford.

Imagine no healthcare premiums, no health insurance premiums, no co-payment - no out of pocket cost, because a single health care tax pays for all health preserving, treatment, and research costs.

How can this be achieved? Migrate the medical insurance industry to a non-profit medical record industry. Extend the Medicare tax to all income, not just wages, phase the co-pay and caps out. Require all medical companies to phase out profits and become non-profit over a transition period.

Start with the ACA.  Require all medical suppliers, insurance companies, and doctors, and medical service delivery services to participate.  This will insure competition.
